Ruthless gangs long-tied to powerful Haitian politicians and wealthy families and armed with U.S. weapons are terrorizing the Haitian people, kidnapping, raping, and murdering residents of Port-au-Prince at will. The Haiti Criminal Collusion Transparency Act of 2023 would address the root causes of gang violence in Haiti by requiring the State Department to work with other agencies to investigate and sanction corrupt politicians and economic elites colluding with gangs. What is the Haiti Criminal Collusion Transparency Action, S. 396?

Bipartisan legislation introduced by Senate Foreign Relations Chairman Bob Menendez (D-NJ).


Requires the Secretary of State, in coordination with the Intelligence community, to submit a report 90 days after the bill is passed and annually for five years that:

  • Identifies criminal gangs in Haiti, describes their criminal activities, and identifies their primary geographic areas of operations;

  • Lists Haitian political and economic elites who have links to criminal gangs;

  • Describes in detail the relationship between the economic and political elites and criminal gangs;

  • Includes an assessment of how the nature and extent of collusion between political and economic elites and criminal gangs threaten the Haitian people, and U.S. national interests and activities in the country, including the provision of security assistance to the Haitian government; and

  • Includes an assessment of the potential actions that the U.S. Government and the Government of Haiti could take to address the report findings.

  • Requires the Administration to impose sanctions on corrupt political and economic elites unless the President certifies that not sanctioning an individual would serve a vital national interest of the U.S. or is necessary for the delivery of humanitarian assistance.
